Terms of Service
Please read these Terms carefully before using the Experteeth website or attending one of our clinics. These Terms govern your relationship with Experteeth Dental Group and are governed by the laws of New South Wales, Australia.
Last updated: 1 May 2025
1. Agreement to Terms
These Terms of Service ("Terms") govern your use of the website operated by Experteeth Dental Group Pty Ltd (ABN 00 000 000 000) and its associated entities ("Experteeth", "we", "us" or "our") at www.experteeth.com.au (the "Website"), and your access to the services we provide at our dental clinics across Australia (the "Services").
By accessing or using our Website, or by attending one of our clinics as a patient, you agree to be bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, please do not use our Website or Services.
We may update these Terms from time to time. The current version will be published on our Website with the effective date. Your continued use of the Website or Services after any update constitutes acceptance of the revised Terms.
2. Our Services
Experteeth Dental Group provides general and specialist dental services across its network of clinics in Australia. Our clinical services are delivered by registered dental practitioners and qualified clinical staff in accordance with applicable Australian law, professional standards and guidelines issued by the Dental Board of Australia and AHPRA.
The information published on our Website (including articles, service descriptions, FAQs and clinical content) is provided for general informational and educational purposes only. It does not constitute professional dental or medical advice and must not be relied upon as such. You should always seek the advice of a qualified dental practitioner regarding any questions you have about your dental health or treatment.
We reserve the right to modify, suspend or discontinue any aspect of our Services at any time without notice.
3. Appointments and Cancellations
Appointment bookings made through our Website, by telephone or in person are subject to availability. A confirmed appointment does not constitute a guarantee of treatment; clinical assessment on the day of your appointment will determine the appropriate course of care.
We require a minimum of 24 hours' notice for cancellation or rescheduling of appointments. Failure to provide adequate notice, or failure to attend a scheduled appointment without notice (a 'no-show'), may result in a cancellation fee at the discretion of the clinic. We will notify you of any applicable fees before they are charged.
We will make reasonable efforts to notify you of any changes to your appointment due to practitioner unavailability or other unforeseen circumstances.
4. Fees and Payment
Our dental fees are quoted in Australian dollars (AUD) and are inclusive of GST where applicable. A fee estimate will be provided prior to the commencement of treatment. Final fees may vary if additional treatment is required following clinical assessment.
Payment is required at the time of your appointment unless a payment plan has been agreed in writing in advance. We accept payment by cash, EFTPOS, major credit and debit cards, and private health insurance (via HICAPS). We do not bulk-bill Medicare for dental services, except for eligible child dental benefit schedule (CDBS) items.
Private health insurance rebates are processed at point of sale via HICAPS for participating funds. Your rebate entitlement is determined by your fund and health cover level. Experteeth does not guarantee any specific rebate amount.
Outstanding accounts may be referred to a debt collection agency. You agree to pay all reasonable costs of debt collection, including legal costs on a solicitor-client basis, should your account remain unpaid.
5. Private Health Insurance and Medicare
Experteeth accepts most major Australian private health funds. We participate in HICAPS for on-the-spot claiming. The rebate you receive is determined by your fund, your level of cover and applicable waiting periods. We recommend confirming your entitlements with your fund prior to treatment.
Eligible patients under the Child Dental Benefits Schedule (CDBS) may access Medicare-funded dental services at our participating clinics, subject to annual benefit caps and item eligibility as determined by Services Australia.
Experteeth does not make representations regarding your entitlements under any private health fund or government benefits program. You are responsible for understanding and managing your own health cover.
6. Informed Consent and Clinical Care
All dental treatment is performed only with your informed consent. Before commencing any procedure, your treating practitioner will explain the proposed treatment, its benefits, risks and alternatives, and will give you the opportunity to ask questions. You have the right to refuse or withdraw consent at any time.
Your treating practitioner will use their professional judgement to determine the most appropriate clinical approach. Clinical decisions are made in accordance with the standards and guidelines of the Dental Board of Australia, the Code of Conduct for Registered Health Practitioners, and applicable clinical evidence.
If you have a complex medical history or are taking medications that may affect dental treatment, it is your responsibility to disclose this information fully and accurately to your treating practitioner prior to treatment. Experteeth accepts no liability for adverse outcomes resulting from failure to disclose relevant medical information.
7. Limitation of Liability
To the maximum extent permitted by Australian law, including the Australian Consumer Law (ACL) contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth), Experteeth's liability for any loss or damage arising out of or in connection with the use of our Website or Services is limited as follows:
In relation to clinical services: our liability is subject to the professional standards and mandatory guarantees applicable to healthcare services in Australia. Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that you may have under the ACL or any other applicable law that cannot be excluded.
In relation to the Website and online content: to the fullest extent permitted by law, Experteeth is not liable for any direct, indirect, incidental, special, consequential or exemplary damages arising from your use of or inability to use the Website, including damages for loss of data, loss of profits or business interruption, even if we have been advised of the possibility of such damages.
The Website may contain links to third-party websites. We do not control or endorse those websites and accept no responsibility for their content, accuracy or privacy practices.
8. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted or modified by agreement.
To the extent that our liability for a failure to comply with a consumer guarantee cannot be excluded, our liability is limited (at our option) to: the supply of the relevant service again; or the payment of the cost of having the service supplied again.
Our Services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have the problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
